Susan Wagner Release to Commissioners of Union County Recorded July 23rd, 1938.
WHEREAS, by an Act of Assembly of the Commonwealth of Pennsylvania, approved May 31, 1911, P. L. 408, and the supplements and amendments, thereto, the Secretary of Highways of said Commonwealth is authorized and directed and empowered to construct or improve certain highways therein designated as "State Highways" and "State Aid Highways", and in so doing divert, when necessary, the course of direction of the same under conditions prescribed in said legislation; and
WHEREAS, the Secretary of Highways has reconstructed and improved under the provisions of said act and the supplements and amendments thereto, a section of road in West Buffalo Township, Union County, Pennsylvania, designated in the records of the State Highway Department Legislative Rout 59017; and
WHEREAS, in constructing and improving said road it was necessary to construct same through lands of Susan Wagner, located in West Buffalo Township, which lands were conveyed to said Susan Wagner, by deed from Margaret E. Hummel, date October 29, 1912, and recorded in Dee Book "SS" page 353; and as a result of the re-location and construction of said highway it was necessary to take a portion of land at that place as shown by blue print on file in the Commissioners' Office of Union County, thereby causing her damage by such taking;
NOW, KNOW ALL MEN BY THESE PRESENTS, that I Susan Wagner, of West Buffalo Township, Union County, Pennsylvania, owner of property situate in said West Buffalo Township, and through which said land said state highway has been constructed, for and in consideration of the sum of one hundred fifty ($150.00) dollars, to me in hand paid by the Commissioners of Union County, Penna., the receipt of which payment is hereby acknowledged, do hereby remise, release, quit claim and forever discharge the Commissioners of Union County, Pennsylvania, and the County of Union, of and from all suits, damages, claims and demands whatsoever, in law or equity or otherwise, for or by of said road as it is now located on the premises, and as shown and indicated by the plans, drawings, and specifications of such highway on file in the Commissioners' Office of Union County, Pennsylvania; or for or by reason of any divergence of said road from it original location, in its reconstruction, for ort by reason of taking land necessary for the widening, location, relocating or, construction of said road in order that the State Highway may properly provide for the traveling public, as above indicated and mentioned.
